This Policy complies with the Copyright Act 1994 (New Zealand) and the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512 (United States). We respond to valid notices of alleged copyright infringement from anywhere in the world.

1. REPORTING COPYRIGHT INFRINGEMENT 

1.1 Notice Requirements. If you believe that content on our Services infringes your copyright, send a written notice to our Designated Copyright Agent with ALL of the following information:    
a) Identification of Work: A description of the copyrighted work you claim has been infringed, or if multiple works, a representative list;      
b) Location of Infringing Material: The URL or description of where the allegedly infringing material is located on our Services, sufficient for us to find it;      
c) Your Contact Information: Your full legal name, mailing address, telephone number, and email address;      
d) Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;      
e) Accuracy Statement: A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner;      
f) Signature: A physical or electronic signature of the copyright owner or person authorized to act on their behalf.

1.3 Invalid Notices. We may disregard notices that do not substantially comply with Section

1.1.Submitting false claims may result in liability for damages, including costs and attorneys' fees, under Section 512(f) of the DMCA and NZ law. 


2. OUR RESPONSE TO VALID NOTICES 

2.1 Removal or Disable Access. Upon receipt of a valid infringement notice, we will expeditiously remove or disable access to the allegedly infringing material. This may occur without prior notice to the user who posted it. 

2.2 Notification to User. We will make reasonable efforts to notify the user who posted the content that it has been removed due to a copyright complaint, and provide them with a copy of the notice. 

2.3 Account Termination for Repeat Infringers. We will, in appropriate circumstances, terminate accounts of users who are repeat infringers. A "repeat infringer" is a user who has been the subject of more than two valid takedown notices. 


3. COUNTER-NOTIFICATION 

3.1 If You Believe Removal Was Error. If your content was removed due to a copyright complaint and you believe this was a mistake or misidentification, you may send us a Counter-Notice containing ALL of the following:    
a) Identification:Description of the material removed and its location before removal;      
b) Statement Under Penalty of Perjury: That you have a good faith belief the material was removed due to mistake or misidentification;      
c) Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the US, that you consent to jurisdiction of the courts of New Zealand, and that you will accept service of process from the complainant;      
d) Contact Info: Your name, address, telephone number, and email;      
e) Signature: Your physical or electronic signature. 

3.2 Submit Counter-Notices To: legal@blanchekohen.com with subject line "Counter-Notice" 

3.3 Our Actions After Counter-Notice. If we receive a valid Counter-Notice, we will forward it to the original complainant. If the complainant does not file a court action seeking to restrain the user within 10-14 business days, we may restore the removed material at our discretion. We will not restore material if we receive notice that legal action has been filed. 


4. USER-GENERATED CONTENT 

4.1 Your Responsibility. You are solely responsible for content you upload to Menojoy App, including journal entries, profile images, or community posts if such features exist. You represent that you own or have all rights necessary to post such content. 

4.2 No Pre-Screening. We do not pre-screen user content but reserve the right to remove content that violates these Terms or this Policy. 


5. TRADEMARK COMPLAINTS To report trademark infringement,email legal@blanchekohen.com with:
(a) your trademark registration,
(b) the allegedly infringing use, and
(c) your contact info. We respond to valid trademark complaints under applicable law. 


6. RETALIATORY CLAIMS Do not file fraudulent or bad-faith takedown notices. Misuse of this process may expose you to legal liability. We may report fraudulent notices to authorities. 


7. MODIFICATIONS We may update this Policy at anytime. Check "Last Updated" date. Continued use after changes constitutes acceptance.
