1. SCOPE AND LEGAL FRAMEWORK
1.1 Primary Law. As a New Zealand company, we comply with the Privacy Act 2020 (NZ) and the Information Privacy Principles ("IPPs").
1.2 International Users. If you are located in the European Economic Area ("EEA"), United Kingdom, or California, we also comply with the General Data Protection Regulation ("GDPR") and California Consumer Privacy Act ("CCPA/CPRA") respectively. Where laws conflict, we apply the highest standard of protection.
1.3 Controller. Blanche Kohen LLC is the "data controller" of your personal information under GDPR and "business" under CCPA.
2. INFORMATION WE COLLECT
2.1 Information You Provide:
a) Account Data: Name, email, password when you create an account
b) Profile Data: Age, health information, symptoms, cycle tracking, wellness goals you voluntarily enter into Menojoy App
c) Payment Data: Billing name, last 4 digits of card. Full payment details are processedby Stripe, Apple, or Google. We do not store full card numbers
d) Communications: Messages sent to support@blanchekohen.com
e) Quiz Responses: Answers submitted on WomenOver40Clarity.com
2.2 Information Collected Automatically:
a) Device Data: Devicetype, operating system, app version, unique device identifiers
b) Usage Data: Features used, time in app, screens viewed, crash reports via Firebase
c) Log Data: IPaddress, browser type, access times, referring URLs
d) Cookies: See Section 6
2.3 We Do NOT Collect:
a) Government IDs, Social Security Numbers, or precise geolocation
b) Protected HealthInformation ("PHI") under HIPAA. We are NOT a HIPAA covered entity
3. HOW WE USE YOUR INFORMATION We use your information to:
1. Provide the Services:Operate Menojoy App, display your tracked data, process subscriptions
2. Improve Services: Analyze usage via Google Analytics and Firebase to fix bugs and add features
3. Communicate: Send transactional emails, respond to support requests, send subscription notices
4. Marketing: With yourconsent, send educational content and offers. Opt out anytime via email footer
5. Security: Detect fraud,enforce Terms, comply with law
6. Legal: Respond to lawful requests from authorities Legal Bases under GDPR (for EU/UKusers):
- Contract: To provide Menojoy App per our Terms
- Legitimate Interest: To improve and secure Services
- Consent: For marketing emails and non-essential cookies
- Legal Obligation: To comply with NZ and applicable laws
4. HOW WE SHARE YOUR INFORMATION
4.1 We Do NOT Sell Your Data. We have never sold personal information and will not do so.
4.2 Service Providers. We share data with third parties who help operate the Services:
- Stripe: Payment processing. See stripe.com/privacy
- Google Firebase: App hosting, analytics, crash reporting. See policies.google.com/privacy
- Google Analytics: Usage analytics. Anonymized. Opt out: https://tools.google.com/dlpage/gaoptout
- Apple/Google: If you purchase via App Store or Google Play
- Email Provider: Transactional emails All providers are contractually bound to protect your data and use it only for services to us.
4.3 Legal Disclosure. We may disclose information if required by law, court order, or to protect rights, safety, orproperty of Blanche Kohen LLC or others.
4.4 Business Transfer. If Blanche Kohen LLC is acquired or merged, your information may transfer to the new owner. We will notify you via email and app notice.
4.5 Aggregated Data. We may share anonymized, aggregated statistics that cannot identify you, e.g., "70% of users track sleep."
5. INTERNATIONAL DATA TRANSFERS -IPP 12 COMPLIANCE
5.1 Data Storage Location.Your data is stored on servers in the United States via Google Firebase and Stripe.
5.2 Safeguards. For transfers from NZ, we comply with Information Privacy Principle 12 of the Privacy Act 2020. For transfers from the EEA/UK, we rely on Standard Contractual Clauses approved by the European Commission. Google and Stripe are certified under applicable data transfer frameworks and provide equivalent protection.
5.3 Your Consent. By using the Services, you consent to transfer of your information to the United States and other countries where our service providers operate. These countries may have different data protection laws than your country.
6. COOKIES AND TRACKING
6.1 Types of Cookies:
- Essential: Required for login, security, payments. Cannot be disabled
- Analytics: Google Analytics to understand usage. You can opt out via browser settings
- Preference: Remember your settings in Menojoy App
6.2 Your Choices. You can control cookies through browser settings. Disabling essential cookies will break the Services. To opt out of Google Analytics: https://tools.google.com/dlpage/gaoptout
6.3 Do Not Track. We do not respondto DNT signals because no consistent standard exists.
7. DATA RETENTION
7.1 Account Data. We retain your account and profile data while your account is active. If you delete your account via Menojoy.app/account,we delete or anonymize your data within 30 days, except as required by law.
7.2 Legal Retention. We retain payment records for 7 years to comply with NZ tax law. Anonymized analytics maybe retained indefinitely.
7.3 Backups. Deleted data may persist in encrypted backups for up to 90 days before permanent deletion.
8. DATA SECURITY
8.1 Measures. We use industry-standard safeguards: encryption in transit (TLS), encryption at rest, access controls, and regular security reviews. Stripe and Firebase are PCI-DSS and SOC 2 compliant.
8.2 No Guarantee. Nointernet transmission is 100% secure. You use the Services at your own risk. If we discover a data breach, we will notify you and relevant authorities as required by law.
9. YOUR PRIVACY RIGHTS
9.1 New Zealand Users - PrivacyAct 2020. Under IPP 6 and 7, you have the right to:
a) Access: Request a copy of personal information we hold about you
b) Correction: Request correction of inaccurate information
c) Complaint: Complain to the NZ Privacy Commissioner at privacy.org.nz if you believe we breached the Privacy Act Email privacy@blanchekohen.com to exercise these rights. We respond within 20 working days.
9.2 EU/UK Users - GDPR. You have rights to: access, rectification, erasure, restriction, portability,objection, and withdraw consent. Email privacy@blanchekohen.com. You may also lodge a complaint withyour local data protection authority.
9.3 California Users-CCPA/CPRA. You have rights to: know, delete, correct, opt-out of sale/sharing, and non-discrimination. We do NOT sell or share personal information as defined by CCPA. To exercise rights, email privacy@blanchekohen.com or use Menojoy.app/account →"Delete Account". We verify requests and respond within 45 days.
9.4 Global Users. You may access, update, or delete your account data anytime at Menojoy.app/account. To delete all data, use "Delete Account" or email privacy@blanchekohen.com.
10. CHILDREN'S PRIVACY
10.1 Age Limit. The Services are not directed to individuals under 16. We do not knowingly collect personal information from children under 16 without verifiable parental consent as required by the Privacy Act 2020 and COPPA.
10.2 Parental Notice. If you believe a child under 16 provided us information, contact privacy@blanchekohen.com.We will delete it immediately.
11. HEALTH DATA DISCLAIMER
11.1 Not PHI. Any health, wellness, or symptom information you enter into Menojoy App is for personal tracking and educational purposes only. It is NOT Protected Health Information under HIPAA. Blanche Kohen LLC is not a HIPAA covered entity, healthcare provider, or business associate.
11.2 Not Medical Advice. Menojoy App does not provide medical diagnosis or treatment. See Terms of Service Section 12 and Medical Disclaimer. Always consult your physician.
12. BREACH NOTIFICATION If we become aware of a privacy breach that poses a risk of serious harm, we will:
1. Notify the NZ Privacy Commissioner as required by the Privacy Act 2020;
2. Notify affected users by email without undue delay; and
3. Notify other regulators if required by GDPR or other laws.
13. CHANGES TO THIS POLICY
We may update this Privacy Policy. Material changes will be notified by email or in-app notice 30 days before theytake effect. Continued use after changes constitutes acceptance. Check "Last Updated" date for current version.
