This End User License Agreement (“EULA”) is a legal agreement between you and Blanche Kohen LLC (“Blanche Kohen”, “we”, “us”) governing your use of the Menojoy mobile application (“Licensed Application”).

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THIS EULA. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE LICENSED APPLICATION AND DELETE IT FROM YOUR DEVICE.
1. Acknowledgement
1.1 Parties
This EULA is between you and Blanche Kohen LLC only. Apple Inc. and Google LLC are not parties to this agreement and are not responsible for the Licensed Application or its content.
1.2 App Store TermsYour use of the Licensed Application may also be governed by the Apple App Store Terms of Service and the Google Play Terms of Service. If there is a conflict, this EULA applies.
2. Scope of License
2.1 License GrantSubject to this EULA, you are granted a limited, non‑exclusive, non‑transferable, revocable license to install and use the Licensed Application on an Apple‑branded or Android device you own or control, for personal, non‑commercial use.
2.2 Family Sharing & Device UseiOS: Use is permitted under Apple’s Family Sharing rules.Android: You may install the App on devices linked to your Google account.
2.3 RestrictionsYou may not:copy, distribute, rent, lease, or lend the Licensed Applicationreverse engineer, decompile, or disassemble itremove or alter proprietary noticesuse it for unlawful purposes or to transmit harmful codeuse it to develop a competing productAny prohibited use is a material breach of this EULA.
3. Consent to Use of DataYou agree that Blanche Kohen LLC may collect and use technical and usage data—including device information, app interactions, and crash reports—as described in our Privacy Policy. This information helps us improve the Licensed Application and provide support.
4. Subscriptions & In‑App Purchases
4.1 Plans & Pricing (USD)
Clarity — $19/month (auto‑renewing)
Believed — $99/year (auto‑renewing)
RN Advocacy — $499/year (auto‑renewing)
Relief — $299 one‑time purchase (lifetime access)
4.2 Auto‑RenewalSubscriptions renew automatically unless cancelled at least 24 hours before the renewal date. Relief does not renew.
4.3 No Free TrialsPayment is charged immediately. No free trials are offered.
4.4 BillingPayment is charged to your Apple ID or Google Play account at confirmation of purchase.
4.5 Managing Your SubscriptionYou may manage or cancel your subscription through:iOS: Settings → Apple ID → SubscriptionsAndroid: Google Play → Payments & subscriptions
4.6 Refunds
All sales are final, except for duplicate charges.iOS refunds must be requested from Apple: https://reportaproblem.apple.com

5. Health Disclaimer — Not Medical Advice
5.1 Informational OnlyThe Licensed Application provides menopause and wellness information for educational purposes only. It is not medical advice, diagnosis, or treatment.
5.2 Consult ProfessionalsAlways seek advice from a qualified health provider for medical concerns. Do not disregard professional guidance because of content in the Licensed Application.
5.3 No Doctor‑Patient RelationshipUsing the Licensed Application does not create a doctor‑patient relationship.
5.4 EmergenciesFor urgent medical concerns, contact your doctor or local emergency services immediately.
5.5 No HealthKit / Google Health IntegrationThe Licensed Application does not currently integrate with Apple HealthKit or Google Health Connect.
6. Maintenance & Support
Blanche Kohen LLC is solely responsible for maintenance and support.Apple and Google have no support obligations.

7. Warranty
7.1 No WarrantyTo the maximum extent permitted by law, the Licensed Application is provided “as is” and “as available”, without warranties of any kind.
7.2 NZ Consumer Guarantees Act (CGA)
Nothing in this EULA excludes your non‑excludable rights under the Consumer Guarantees Act 1993 (NZ).
7.3 App Store Warranty
If the Licensed Application fails to meet an applicable warranty, Apple may refund the purchase price. Apple has no other warranty obligations.
8. Product ClaimsBlanche Kohen LLC is responsible for addressing claims relating to the Licensed Application, including product liability, regulatory compliance, and consumer protection matters. Contact support@blanchekohen.com for assistance.
9. Intellectual Property Rights9.1 OwnershipBlanche Kohen LLC owns all rights, title, and interest in the Licensed Application. This EULA does not grant ownership rights.
9.2 Infringement ClaimsBlanche Kohen LLC is responsible for investigating and resolving third‑party intellectual property claims.
10. Legal ComplianceYou represent that you are not located in a country subject to NZ or US embargoes and are not listed on any prohibited party lists.
11. Limitation of Liability
11.1 No Indirect DamagesTo the maximum extent permitted by law, Blanche Kohen LLC is not liable for indirect, incidental, or consequential damages.
11.2 Liability CapOur total liability is limited to the amount you paid in the 12 months preceding the claim, or USD $100, whichever is greater.
11.3 ExceptionsThese limitations do not apply where prohibited by New Zealand law.
12. Termination
12.1 Term
This EULA remains in effect until terminated by you or Blanche Kohen LLC.
12.2 Termination for Breach
Your rights terminate automatically if you fail to comply with this EULA. Upon termination, you must stop using and delete the Licensed Application.
12.3 Survival
Sections relating to health disclaimers, warranties, intellectual property, liability, and governing law survive termination.
13. Third‑Party Beneficiary
Apple Inc. and Google LLC are third‑party beneficiaries of this EULA and may enforce it.
14. Governing Law
This EULA is governed by the laws of New Zealand. You submit to the exclusive jurisdiction of the courts of Wellington, New Zealand.
